Can I omit a creditor from my bankruptcy? Can I omit a creditor from my bankruptcy?

What if I owe my brother money but I don’t want him to know that I am going bankrupt.

My trustee has said that the money I have already paid him must be mentioned in my claim and a letter sent to him. I do not want to do this.

Can I go to a different trustee?

If you have already signed the documents then you are in bankruptcy and cannot go to a different trustee.

If you have not signed any documents then you can go to a different trustee.

I must caution you, that even if you go to a different trustee you still must declare the debt to your brother and the trustee must send him a notice.

If you do not declare the debt and are found out there are serious consequences to violating the bankruptcy laws.
