Can my creditors garnish my wage without advance notice to me?
I live in Edmonton, Alberta, and I’m 4 months behind on my credit cards payments. Can my creditors garnish my wage without advance notice to me or do they have to take me to court before it happens?
I find very confusing answers on the internet, some says I can defend myself in court before it happens, others say they can do it without my knowledge.
Creditors have to get a judgement at the court before they can garnishee your wages. This does not apply to CRA.
If a wage garnishee is put in place you can have it removed in a matter of hours, by filing bankruptcy or a consumer proposal.
