Hi, can you please answer this question for me…

My ex-spouse and I claimed bankruptcy 6 years ago but did not claim on the mortgage. I since left my husband and he was to continue paying my portion of the mortgage in lieu of child support. He stopped paying the mortgage and the house went into foreclosure. Is it possible that we can claim on just the mortgage? I have been able to keep myself out of debt up to this point and now I am being called by collections to pay the balance.

You can file bankruptcy again and the mortgage debt will be erased.

When you file bankruptcy you will have to include all your debt.

You cannot pick and chose which debts to include in your bankruptcy filing.
