Creditor not included in the bankruptcyCreditor not included in the bankruptcy.   We have been asking a former customer to pay an amount owing on their account since last fall.   The customer recently told us they signed bankruptcy papers two months ago.

We were not contacted by a trustee, so obviously we were not included as a creditor.  How can we be paid?

Do we have to wait until this person is discharged?

It is not too late for you to share in any proceeds generated in this bankruptcy.

Advise the trustee that you are a creditor and they will send you documents concerning the bankruptcy, including a Proof of Claim form, you can fill out to lodge your claim.
