In a civil case, not criminal…we are struggling as it is..no way can we afford to pay this off, if forced to..we will have to declare bankruptcy…

Yes, the filing of a bankruptcy would erase a civil lawsuit debt upon the bankrupt’s discharge.

Even filing before the conclusion of the lawsuit would kill the lawsuit and prevent you from being sued successfully.
