Why does the trustee want a copy of my tax return when it was my spouse who filed bankruptcy? Why does the trustee want a copy of my tax return when it was my spouse who filed bankruptcy?

My spouse received a request for the information to file their tax return. In the list is a request for my tax return. Why do I have to give this? They already know my income. We’ve been reporting on time and as demanded.

Even though they have demanded and I have given them my monthy bank statements as part of the monthly “family submissions”?” Even though I have provided everything they have asked. I feel like I am being treated as the bankrupt. If, for whatever reason, I get some money back, will they take it from me?
I have been seriously considering consulting an attorney. My partner is afraid that the trustee will demand to know how I paid for one as I don’t make very much. Would I have to explain or can I tell him to buzz off? I don’t understand why the trustee is demanding so much information from me and I am growing increasingly uncomfortable with the demands for my personal information, receipts, etc. Should I consult a lawyer?

The trustee wants your tax return to confirm the income you have been reporting on your bankruptcy paperwork. Your trustee is required to confirm this information.

So long as you were reporting your income correctly, any reasonable tax refund will not be taken.

It is your right to consult a lawyer and no one will question your abilitity to pay for the services of a bankruptcy lawyer.
