How does a consumer proposal work, and is it right for me and my debt situation?

One option for getting out of debt in Ajax is to file a consumer proposal.

A consumer proposal is a popular alternative to personal bankruptcy that is a legal process administered under the Bankruptcy and Insolvency Act.

The Canadian government regulates the Bankruptcy & Insolvency Act, which sets the laws for consumer proposals and bankruptcies in Canada.

A consumer debt proposal allows you to repay only a part of the total debt you owe.

The amount you repay is based on your income and must be a fair agreement for your creditors, but you often end up repaying as little as 30 cents on the dollar on the total unsecured debt you own.

For example, after meeting with a consumer proposal administrator (a Licensed Insolvency Trustee), the Trustee determines you can afford to repay $300 a month towards your consumer proposal for 5 years (the maximum term a consumer debt proposal can be for).

You agree that $300 is a fair deal for you and your creditors and you elect to make this proposal to your creditors through your Proposal Administrator.

Your creditors accept the proposal and you being repaying $300 a month for the next 5 years which is a total of $18,000.

Since you owe $60,000 in credit card debt, a line of credit, payday loans and income taxes, your $18,000 consumer proposal represents a 70% reduction in your total debt.

Under a consumer proposal you won't pay any interest and your administrators' fees are paid out of your $300 monthly payment.

You must work with a Licensed Insolvency Trustee to file a Consumer Proposal as only Licensed Insolvency Trustees are licensed by the federal government to provide consumer proposal services.
